The Sheboygan County Board of Supervisors approved Chapter 78-Nonmetallic Mining Reclamation Ordinance at their May 15, 2001 County Board meeting, and amended in May 2007. The goal of the ordinance is to ensure a safe and environmentally sound land use for the mining site after mining operations have ceased.
The ordinance in effect means that any proposed mining site (gravel, sand, or other nonmetallic minerals) will be required to have an approved reclamation permit to continue mining operations in Sheboygan County. Exceptions include a mining site less than one acre in size and sites used for agricultural or personal uses.
Current active nonmetallic mining operations in Sheboygan County have a permit. Applying for the permit will ensure that operators will be able to begin and continue mining operations. Any mining operation applying for reclamation permit will be required to submit the actual reclamation plan, which will identify the measures to be used in restoration and a final land use and Financial Assurance to guarantee reclamation. Mining cannot begin until Sheboygan County has issued a reclamation permit.
The Sheboygan County Land & Water Conservation Department will be administering the ordinance. Chapter 78 was developed through Chapter NR 135, Nonmetallic Mining Reclamation, administered by the Wisconsin Department of Natural Resources.
Any town or municipality in Sheboygan County may develop and administer their own nonmetallic mining reclamation program within the guidelines of Chapter NR 135.
Restoring active nonmetallic mining sites according to the reclamation plan and permit will ensure the final land use is implemented. This program will not improve sites that have discontinued mining operations prior to December 1, 2000.
